In Greene County district court Estavan Espinosa Jones, 27, of Des Moines was sentenced May 10 to 60 days in jail after he pleaded guilty to a charge of operating without owner’s consent, amended from theft- first degree. He will receive credit for time served and sheriff’s “good time” credit. Jones was fined $625 with a $218.75 surcharge; both were suspended. He must pay a $125 Law Enforcement Initiative surcharge, $600 restitution for his court appointed attorney’s fees and $304.33 court costs. (Sentencing: Honorable Joseph B. McCarville)
Adam Michael Winger 38, of Jefferson was sentenced to five years in prison after he changed his plea to guilty to a charge of possession of a controlled substance- third offense. The prison term was suspended and he was placed on probation for three years. He was fined $750 with a $262.50 surcharge; both were suspended. He must pay a $125 LEI surcharge and $140 court costs. Juan Carlos Jimenez, 23, of Scranton was granted a deferred judgment after he changed his plea to guilty to a charge of possession of marijuana. He was placed on probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He must pay a $315 civil penalty, a $125 LEI surcharge and $140 court costs. Douglas Wayne Shutt, 58, of Grand Junction was sentenced to 10 years in prison after he changed his plea to guilty to a charge of theft- first degree. The prison term was suspended and he was placed on probation for three years. He was fined $1,000 with a $350 surcharge and a $125 LEI surcharge. The criminal charge is the result of Shutt collecting his deceased wife’s Social Security benefit; he must pay $15,289 restitution. The judge found him unable to pay restitution for his court appointed attorney’s fees and court costs. (Sentencing: Honorable Gary McMinimee)
Thomas Richard Langford, 52, of Dana was granted a deferred judgment after he changed his plea to guilty to a charge of operating while intoxicated- first offense. He was placed on informal probation for one year. He must undergo a mental health evaluation and follow any resulting recommendations. He must also complete a community college drinking drivers school. A judgment was entered for a $1,250 civil penalty; one-half will be waived if he is able to obtain a temporary restricted license. Garrett Lane McDowell, 18, of Grand Junction was sentenced to 30 days in jail after he pleaded guilty to a charge of eluding. The jail time was suspended and he was placed on informal probation for one year. McDowell was fined $315 with a $110.25 surcharge; both were suspended. He must pay a $10 drug abuse resistance education (DARE) surcharge and $140 court costs. (Sentencing: McCarville)
Bradley Erik Purdy, 22, of Rippey was sentenced to 10 years in prison after he changed his plea to guilty to a charge of lascivious acts with a child. He was sentenced to 270 days in jail on a charge of indecent exposure. The prison and jail sentences are concurrent, but the prison term was suspended and he was placed on probation for three years. Judge McMinimee invoked special sentencing guidelines – on the lascivious acts charge, upon completion of the sentence he will remain in the custody of the Iowa Department of Corrections for the rest of his life. The special sentence will begin as if he were on parole or work release. On the indecent exposure charge, the special sentence will be in place for 10 years. He will be placed on the Iowa Sex Offender Registry for the length of the special sentence.
Purdy was fined $1,000 with a $350 surcharge and a $100 sex abuse surcharge on the lascivious acts charge. He was fined $350 with a $122.50 surcharge and a $100 sex abuse surcharge on the indecent exposure charge. He must also pay $1,250 restitution for his court appointed attorney’s fees and $247.50 court costs. Other charges against Purdy were dismissed. (Sentencing: McMinimee)
Greg William Hackler, 28, of Jefferson was sentenced to 10 days in jail after he changed his plea to guilty to a charge of driving while license barred. He must pay sheriff’s room and board fees for the time he serves. He was fined $1,000 with a $30 surcharge; both were suspended. Court costs were $100. (Sentencing: McCarville)
Richard Lee Norton Jr, 39, of Panora was sentenced to five years in prison after he changed his plea to guilty to a charge of OWI- third offense. All but 30 days of the prison term was suspended. He can complete some of the jail time at a residential correctional facility if a bed becomes available; he is to remain in the facility until he obtains the maximum benefits. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He driver’s license was revoked for six years.
Norton was fined $3,125 with a $1,093.75 surcharge; both were suspended. He must pay a $10 DARE surcharge. The judge found him to be unable to pay restitution for his court appointed attorney’s fees and court costs. (Sentencing: McCarville)
Jessica Ann Marie Kelton, 19, of Jefferson was sentenced to seven days in jail after she changed her plea to guilty to a charge of possession of marijuana- second offense. The jail time was suspended and she was placed on unsupervised probation for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Persons pleaded not guilty at arraignment as follows: Megan Ann Stuhr, 24, of Fort Dodge, identity theft- fourth degree; Branden Gerrick Smith, 42, of Jefferson, domestic abuse assault- third or subsequent offense and criminal mischief- third degree; Martin John Tolsdorf, 54, of Grand Junction, possession of a firearm as a felon, and in a separate case, manufacture, deliver or possess methamphetamine with intent to deliver, possession of marijuana- third or subsequent offense, and unlawful possession of prescription drug;
Tyler James Smits, 26, of Jefferson, harassment- first degree; Juan Carlos Delgado Ramos, 42, of Alta, OWI- first offense; and Justin Jeffrey Baker, 31, of Grand Junction, carrying weapons- knife longer than 5 inches. Trial dates were set for June 4 for Smith, June 18 for Delgado Ramos and Tolsdorf, and July 23 for Stuhr, Smits and Baker.
